1. Scope of these terms
These Terms of Service govern your use of BlackTimberOutfitters.com, inquiry forms that link to these terms, and the Black Timber Outfitters text-messaging program. "Black Timber," "we," "us," and "our" refer to Black Timber Outfitters.
Please review these terms before using our services. By using the website, you agree to these terms to the extent an agreement is formed under applicable law. If you do not agree, discontinue use. Our Privacy Policy explains how personal information is handled. Merely visiting the website, submitting an inquiry, or accepting these terms does not enroll you in SMS marketing.
These website terms are not a hunt reservation, outfitting contract, liability waiver, or release of claims. A specific hunt is governed by its separate written agreement and any other properly accepted documents applicable to that trip. If a written hunt agreement conflicts with these website terms on the services or booking, that agreement controls those matters.
2. Who may submit an inquiry
You must be at least 18, or the age of legal majority where you live if higher, to independently enter a service agreement or enroll in our SMS program. A parent or legal guardian should arrange inquiries and any participation for minors. Eligibility to participate in a hunt is determined separately by applicable law and the trip's requirements.
Provide accurate contact and trip information, and use a telephone number or email address you are authorized to use. Do not impersonate another person or submit someone else's information without appropriate permission.
3. Hunt information, availability, and booking
Our website describes hunting opportunities and provides planning information. Species, seasons, destinations, prices, dates, guide assignments, accommodation, access, and other details may change. An inquiry form, website description, conversation, or automated acknowledgment does not guarantee availability or create a reservation.
A booking is confirmed only when the parties complete the applicable written booking arrangements and any stated confirmation requirements. Review the written proposal or agreement for dates, price, payment schedule, deposits, cancellation and refund provisions, inclusions, exclusions, party size, and each party's responsibilities before committing.
These website terms do not create a standard nonrefundable deposit rule, cancellation fee, refund guarantee, or transfer right. Those matters must be stated in the agreement for your specific hunt. If any booking provision is unclear, obtain clarification from the team before signing or paying.
4. Tags, permits, hunting rules, and participant responsibilities
Hunting is subject to applicable federal, state, tribal, and local rules and to land-access requirements. You are responsible for ensuring that you hold the licenses, tags, permits, and qualifications required for your participation unless your written agreement expressly assigns a particular administrative task to us. Our planning assistance does not guarantee a successful draw, permit, tag, or agency decision.
Confirm current requirements with the responsible wildlife agency and land authority, including authorized species, unit, dates, methods, hunter education, equipment, access, and reporting obligations. Website summaries do not replace official rules. You must comply with applicable law and reasonable instructions provided for the lawful and safe operation of a trip.
Discuss your experience, equipment, physical readiness, and any accommodation needs with the team early enough to assess the proposed arrangements. Do not send detailed medical records, government identifiers, or payment-card information through general inquiry forms.
5. Outdoor conditions and results
Hunting and outdoor travel involve changing terrain, weather, wildlife, access conditions, and other factors outside anyone's complete control. No website content promises a harvest, encounter, trophy size, score, weather condition, or particular outcome.
Photographs and testimonials reflect particular experiences and do not guarantee similar results. Wildlife and landscape illustrations communicate a setting and are not representations that a specific animal, location, or result is available on a particular trip.
Risk disclosures, emergency arrangements, cancellation consequences, and any required participant acknowledgments belong in the documents for your specific hunt. Nothing in these website terms substitutes for those arrangements or excuses obligations that applicable law does not allow us to exclude.
6. Black Timber Outfitters SMS program
What you may receive
If you opt in, Black Timber Outfitters may send SMS or MMS messages at the telephone number you provide. Depending on your selections, messages may include:
• Informational messages: responses to your hunt inquiry, booking details, and trip reminders.
• Promotional messages: hunt opportunities and special offers.
Messages may be sent using automated technology. We will use your consent only for the types of messages you agreed to receive. We do not treat a request for information as unlimited permission to send marketing messages.
Voluntary, separate consent
SMS consent is optional and is not a condition of purchasing services, booking a hunt, or submitting an inquiry. You may submit our forms without selecting an SMS checkbox. Where both types are offered, informational and promotional consent are separate, unchecked choices; you may select either, both, or neither.
Providing your number alone, accepting these terms, or agreeing to the Privacy Policy does not substitute for SMS opt-in. You represent that you are the subscriber or authorized user of the number and can consent to receiving messages there.
Frequency and charges
Message frequency varies according to your selections, inquiries, booking activity, and the communications you request. Message and data rates may apply to messages sent or received under your wireless plan. Contact your carrier with questions about your plan or charges.
Stop messages
Reply STOP to the number sending our program messages to unsubscribe. We will honor your opt-out and may send a final message confirming it. After that confirmation, we will stop the messaging program unless you opt in again. You can also call (801) 891-5873 for assistance with communication preferences.
An SMS opt-out does not cancel a reservation, end a written hunt agreement, or remove any payment obligation. Contact the team separately about booking changes. We may use another appropriate channel for necessary service communications.
Help and rejoining
Reply HELP to a program message for assistance, email josh@blacktimberoutfitters.com, or call Black Timber Outfitters at (801) 891-5873. To rejoin after opting out, complete the available opt-in process again or ask the team how to provide fresh consent. A new inquiry alone does not reverse an opt-out.
Number changes and delivery
If you change or stop using a number, opt out from that number where possible and notify us so we can update your record. Delivery depends on your device, carrier, coverage, and other network conditions. Wireless carriers are not responsible for delayed or undelivered messages. Black Timber cannot guarantee delivery or timing. Text messages are not an emergency service or a substitute for agreed trip communication procedures.
Messaging privacy
Our Privacy Policy applies to the SMS program. We do not sell or rent mobile numbers or SMS consent records, or disclose them to other businesses for their own promotional use. Providers may process the limited information needed to operate messaging and support on our behalf, subject to the policy and applicable law.
7. Permitted website use
You may use the website for lawful personal research, inquiries, and arranging services. You may not:
• Submit false, abusive, threatening, unlawful, or infringing material.
• Use forms or contact features for spam, harassment, or unauthorized promotions.
• Introduce malware, attempt unauthorized access, defeat security controls, or disrupt website operation.
• Collect personal information from the site without authorization.
• Copy or republish protected content, impersonate Black Timber, or imply an endorsement without permission.
We may restrict website access or remove submitted material when reasonably necessary to address misuse, protect the service, or comply with law. This does not automatically cancel or alter a separate booking agreement.
8. Website content and submitted materials
Our branding, text, photographs, designs, and other website content are owned by Black Timber or used with permission unless otherwise indicated. Third-party names and materials remain the property of their respective owners. You may view and save reasonable portions for your personal trip planning. Other reuse requires permission or an applicable legal exception.
You retain ownership of information and materials you submit. You authorize us to use them as reasonably necessary to answer your inquiry and provide the services you request, consistent with the Privacy Policy. Sending us a private inquiry or photograph does not by itself grant permission to publish it as a testimonial or marketing asset. We will seek appropriate permission for that use.
9. External websites and providers
Links to wildlife agencies, social platforms, travel providers, and other websites are offered for convenience. External operators control their own content, availability, terms, and privacy practices. We are not responsible for services you independently purchase from them. Our obligations for any third-party services included in your hunt are determined by the applicable written agreement and law.
10. Website availability and limitations
We aim to provide useful, accurate information, but website content may contain mistakes or become outdated. We may correct content and change or suspend website features. The website is provided on an "as available" basis. To the extent permitted by law, we do not warrant uninterrupted access, error-free operation, or that general website information is suitable for every visitor's circumstances.
To the extent permitted by applicable law, Black Timber is not liable for indirect or consequential losses arising solely from your use of, or inability to access, the website. This limitation does not limit rights that cannot lawfully be excluded, liability for fraud or willful misconduct, or obligations under a separate written hunt agreement. It is not a waiver of claims for injury or negligent provision of outfitting services.
11. Questions and disputes
Please first contact Black Timber Outfitters at (801) 891-5873 to discuss website, messaging, or service concerns so we have an opportunity to help. This request to contact us does not reduce any legal right or deadline.
Applicable law and any valid terms in the relevant written hunt agreement determine the handling of a booking dispute. These website terms do not impose mandatory arbitration, a class-action waiver, or a new shortened claim period.
12. Changes and general provisions
We may update these terms for changes to our website, messaging program, or obligations. The effective date identifies the current version. When required, we will provide additional notice or obtain consent. Updated website terms do not retroactively change an existing written booking agreement or expand your SMS consent.
If part of these terms is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later. Nothing in these terms limits mandatory consumer or privacy rights.
